PRINTING & SHIPPING

Cupid’s Archive relies on various third-party print houses for the production of all printed materials, and as such, production and assembly timelines are subject to the schedules and capacity of these external suppliers. Should client-related delays, including but not limited to, extensive revisions or delayed approvals or responses, threaten to impact the agreed-upon production timeline, the client needs to prepare for delays with their suite production and assembly.

 

Cupid’s Archive cannot be held liable for delays caused by third-party printers or associated service providers. No refunds or credits shall be issued in respect of stationery items that fail to arrive on time due to such external delays or time constraints resulting from client actions or inaction.

INTELLECTUAL PROPERTY, COPYRIGHT & USAGE

Upon receipt of full payment, the client is granted a non-exclusive, non-transferable licence to use the final stationery designs solely for the purposes specified in the initial agreement. This licence does not extend to any other use, reproduction, or modification without the prior written consent of the Cupid's Archive.

The designer retains all intellectual property rights in all design concepts created during the course of the project, including those not selected by the client. Cupid’s Archive reserves the right to use, adapt, sell, or further develop any unselected concepts at its discretion.

The client acknowledges that the final approved stationery designs are for their exclusive use only and must not be reproduced, modified, sub-licensed, or otherwise used by any third party without the designer’s prior written approval. Any unauthorised use, reproduction, or modification of the designs constitutes a breach of this agreement and may result in legal action.

The designer reserves the right to display any work created under this agreement, including final and unused concepts, across its portfolio, website, social media platforms, and other promotional channels.

Both parties agree to maintain the confidentiality of any proprietary or sensitive information disclosed during the course of the project and not to disclose such information to any third party without prior written consent, unless required by law.

CONFIDENTIALITY

Cupid’s Archive reserves the right to showcase completed design work, including both selected and non-selected concepts from look books, across its social media channels, website, portfolio, and other promotional platforms, without the need for further consent from the client.

Cupid’s Archive acknowledges the importance of client confidentiality, particularly in the events industry, and is committed to handling all sensitive information with due care and discretion. Should the client wish to restrict the sharing of their project, or impose specific limitations regarding personal or brand identity, such preferences must be clearly communicated in writing prior to the commencement of the project.

Cupid’s Archive shall not be held liable for the publication or promotional use of any materials where such limitations were not expressly communicated by the client in advance.

BOOKING & PAYMENT

Project commencement and scheduling are contingent upon receipt of the deposit. Upon payment, the client’s project will be allocated a position within the Cupid's Archive schedule. The client agrees to adhere to the payment schedule set out in this agreement.

To secure a booking, a non-refundable payment of 50% of the agreed quotation is required. The final invoice amount may be subject to variation due to, but not limited to, adjustments in quantity, changes in paper stock or print finishes, and design amendments exceeding the standard five (5) rounds of revision.

Final artwork files will not be released to the client, nor sent to print, until the outstanding balance, including any additional charges incurred, has been paid in full and evidence of payment has been provided.

 

An expedited or priority service is available at an additional flat rate of $250, plus any further rush fees charged by third-party contractors, including printers and postal services.

Significant alterations, such as a comprehensive redesign of the initial concept or a full overhaul of key design elements, will attract additional fees. These will be invoiced separately and are payable within five (5) business days of the invoice date. Any changes requested following the client’s final written approval may incur additional charges, which will be advised and invoiced accordingly.

CLIENT REVISIONS & APPROVAL

The client is responsible for carefully reviewing all design proofs and providing timely, consolidated feedback during the revision and approval stages. Final approval of the design must be provided by the client in writing prior to printing. Once written final approval is received, Cupid's Archive will proceed to print; any changes requested thereafter may incur additional charges at the Designer’s discretion.

The client bears sole responsibility for reviewing and approving all content in the design, including but not limited to spelling, grammar, punctuation, layout and factual accuracy. Cupid's Archive shall not be liable for any errors or omissions identified after final approval has been given.

Payment of the remaining balance on the invoice constitutes the client’s confirmation that all designs and files are accurate and approved for production.

EDIT

Our reliance on external printing services dictate our timelines for production and therefore assembly. Should time constraints and extensive client revisions pose a risk to the printing timeline, a warning will be issued. In the unlikely event that a printing warning has been issued, Cupid's Archive disclaims responsibility for any third-party delays, and no refund will be provided for any delayed stationery elements that do not arrive in time.

TERMINATION

If the Client terminates before the work is complete, Cupid's Archive is entitled to payment for all work completed up to the termination date, including any non-refundable deposits. If the Designer terminates due to the Client’s failure to meet obligations (e.g. payment delays, lack of communication), all completed work remains the property of Cupid's Archive until paid in full.
